By accessing or using Eternal Resonance (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service. We reserve the right to modify these terms at any time, and such modifications will be effective immediately upon posting.

2. Description of Service

Eternal Resonance provides a digital memorial platform that allows users to create, manage, and share memorial spaces honoring deceased individuals. Our services include hosting memorial content, facilitating virtual gatherings, and preserving digital legacies.

3. User Accounts

To use certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. User Content

Ownership

You retain ownership of all content you upload to our platform. By uploading content, you grant us a non-exclusive, worldwide license to store, display, and distribute your content solely for the purpose of providing our services.

Content Guidelines

You agree not to upload content that:

• Violates any law or regulation
• Infringes on intellectual property rights
• Contains hateful, abusive, or discriminatory material
• Includes false or misleading information
• Contains malware or harmful code

5. Memorial Space Administration

The creator of a memorial space is designated as its administrator. Administrators have control over privacy settings, contributor access, and content management. We may intervene in disputes over memorial administration at our discretion, prioritizing the wishes of immediate family members.

6. Payment and Subscriptions

Paid plans are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all fees. Prices may change with 30 days' notice. Refunds are available within 30 days of purchase.

7. Data Preservation Commitment

For Eternal plan holders, we commit to preserving memorial content for a minimum of 50 years, backed by a dedicated preservation trust. This commitment survives any potential change in company ownership or status.

8. Intellectual Property

The Service, including its design, features, and content created by us, is protected by intellectual property laws. You may not copy, modify, or distribute our proprietary materials without permission.

9. Limitation of Liability

To the maximum extent permitted by law, Eternal Resonance shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Eternal Resonance and its affiliates from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these terms.

11. Termination

We may suspend or terminate your access for violation of these terms. Upon termination, your right to use the Service ceases, though certain provisions of these terms survive termination. You may request data export before account deletion.

12. Governing Law

These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in San Francisco County, California.
